TERMS & CONDITIONS

As a tour operator, it is important that we have terms and conditions in place to set out our respective responsibilities. It is also important that you read the following before you book as these apply to your booking with us and to all members of your group. It is also important to understand that these Terms and Conditions apply for all bookings with us, whether you have chosen to read them or not, and are applicable for all members of your group.

 

TERMS USED

 

- The “company”, “we”, “us” and “our” means Hens on Tour, a trade mark of Vira Natura Tours/Four Friends Turizm Ltd., a fully licenced Turkish Travel Agengy Tursab no: 7938, incorporated in Turkey with limited liability. When you reserve or book by telephone, email or online you are booking with Hens on Tour.

 

- The “client”, “you” and “your” is all persons named on the booking party (including anyone who is added or substituted at a later date) or any of them, as the context requires. The lead name is the person who makes the booking on behalf of everyone travelling on the booking. The lead name must be 18 years or older at the time of booking.

 

- “supplier” “representative” means the company or person handling or providing the activity or service on our behalf.

 

- ‘tour’ and ‘package’ are bookings consisting of a combination of at least two different types of travel service or ‘activity’ given by ‘us’, “supplier” or “representative”.

 

- ‘Force majeure’; examples include any safety risks, adverse weather conditions, war, riots, civil strife or terrorist activity, aviation issues, access issues, Government intervention/advice, acts of governments/public authorities, local authority disputes, industrial disputes, utility blackouts, cyber warfare, outbreaks, pandemics, natural or nuclear disasters, fire, flood, shortage of water, epidemics, health scares, medical emergency or necessity, airport closures, quarantine restrictions and any other event beyond our control.

 

 

THE CONTRACT

 

Upon booking you are entering into a contract with Hens on Tour. This agreement is to be interpreted and enforced only in accordance with Turkish law. We reserve the right to change the Terms & Conditions at any time prior to a Contract with you.

 

 

BOOKING

 

The following applies only to multi-day tours arranged in advance. A provisional booking may be made by telephone, fax or email, but will only be confirmed after a completed and signed booking form is received (by fax or scan) together with the required deposit of 15% of the cost of the tour either as bank transfer or credit card payment. If for some reason we are unable to confirm your booking we will refund or transfer this deposit whichever you prefer.  We advise you to contact us by email or phone prior to booking to confirm availability before sending any money.  If however, you are booking within 90 days of the tour then full payment is required at the time of booking. Upon booking you are entering a Contract with Hens on Tour. This Contract begins once Hens on Tour issues a deposit receipt and booking confirmation.

 

 

PRICING

 

The price of the tour will not change within 30 days of departure. However, prior to that period we reserve the right to impose a surcharge in the event of government action or currency exchange fluctuations although we will absorb a sum equal to 3% of the tour cost. You will be charged any amount in excess of 3%, but if the surcharge is over 10% of the total tour cost then you have the right to cancel the booking. Any such requests must be received within 10 days of receipt of the surcharge invoice.

If an incorrect price has been entered erroneously, any booking made based on such an (incorrect) price will not be valid. We will contact you to notify you of the error at the earliest opportunity and you will then have the option to decide to pay the correct price or to cancel and receive a full refund of any money you have paid.

All prices will be in the currency stated in the Booking confirmation.

Flights are not included in the price of the tour. Prices only include the services detailed under each activity on our website. Any other expenses are your responsibility.

 

 

PAYMENT

 

All deposits are non-refundable but are transferable.  The balance is due 90 days prior to departure.  If the balance remains unpaid after this date we reserve the right to cancel your booking and retain the deposit.  Should you be forced to cancel you must do so in writing by scan or email.  The following cancellation charges will be levied based on the day the notification is received by us;

90+ days before departure                 deposit only

60-90 days before departure             50% of the total booking price

22-59 days before departure             75% of the total booking price

0-21 days before departure                100% of the total booking price

 

You except responsibility for arranging payments.The lead name of a group booking excepts responsibility for arranging payments for all members of the booking party.

 

Hens on Tour reserves the right not to provide the tours, packages or services or any part thereof until it has received sufficient payment from you. Hens on Tour will not be liable for any issues relating to any such delay in payment. If the deposit and/or balance is not paid on time, Hens on Tour will cancel the Contract and treat this as a cancellation by you. All funds will be kept. If the balance if not paid in time, Hens on Tour will retain your deposit.

 

TRAVEL INSURANCE

 

You must have travel insurance before beginning the tour and it is your responsibility to purchase suitable cover.  This must cover you fully against the cost of cancellation by you and in the unfortunate event you require medical care and repatriation or air evacuation from mountains.  You should know that passenger liability insurance covering the vehicles we use may not be adequate so please ensure that cover is sufficient. Bring the policy with you on the tour.  We do not check policies, this is your responsibility.

Hens on Tour shall not be liable to you if you travel without travel insurance and incur losses attributable to you (through whatever circumstances) that would have been covered by a travel insurance policy (this shall include, but will not be limited to cancellation/curtailment, legal and medical costs that may become payable by you).

 

 

CHANGES TO THE TOUR BY US

 

Sometimes it may become necessary to make changes to the tour and whilst we try our best to provide the tour as confirmed by us we reserve the right to alter or cancel any tour, accommodation, activities or other arrangement.  In the event of small changes such as switching to different but equivalent accommodation we are not obliged to inform you, but will try to do so anyway.  However, if the change is a major one we will notify you as soon as possible and you have the choice of accepting the change, transferring to another tour or cancelling your tour and receiving a full refund.  If we do not receive a reply to any such contacts we will assume you agree to the change. We accept no responsibility for additional expenses due to delays or changes by the air, sea or coach services, nor weather, instances of force majeure*, quarantine and other causes beyond our control. It is in your interests that we reserve the right to alter the itineraries at any time and we will not be held liable for any loss whatsoever caused by changes or delays.  

 

 

CHANGES TO THE TOUR BY YOU

 

You must notify us in writing of any changes you wish to make after your booking form and deposit have been received by us. Most importantly a change of tour or package within 90 days of departure will be treated as a cancellation and the charges outlined above will apply.  Any other changes will incur a 40 GBP administration fee per booking form together with any costs incurred or imposed by any of our service suppliers such as airlines, hotels or transport companies.  We will try our best to help with any change but cannot guarantee we will be able to meet your requests.  Such alterations can only begin upon receipt of the fee.

 

 

OUR LIABILITIES TO YOU

 

All bookings are accepted on the understanding that you come on the holiday at your own risk.  We take all reasonable steps to ensure that the tour you book with us is supplied to an acceptable standard.  However, we cannot accept liability for physical injury, loss, damage or expense resulting from your own actions of the actions or omissions of those involved in your holiday over which we have no direct control such as but not exclusively airlines, transport companies and hotel employees. Of course we accept no responsibility for any scenario of force majeure* and shall not be liable for any consequential loss or damage, detention, delay or overcharge however caused.

 

 

HEALTH

 

Please ask about the level of exertion for each activity on the tour or package before booking.  We accept your booking on the understanding that you are normally in good health and that you are fully capable of the physical demands of the tour. You are responsible for ensuring you do not impair, restrict or endanger yourself or other members of your party or any third party.

For more active trips we reserve the right to request a doctor’s certificate stating that it is safe for you to participate.

It is in your best interests to declare all significant medical conditions to us in case of any emergency. You must always act in a safe, responsible and courteous manner, comply with all safety instructions (and not under the influence of alcohol or illegal drugs). We are not liable for any incidence where a member of the party is unable to participate in an activity for health reasons.

 

 

DISCLAIMER

 

We endeavour to provide as much information prior to activities. However, due the extreme nature of some activities you may occasionally be asked to acknowledge and agree to local disclaimers. These indicate the risks associated with any activity. If you are given a disclaimer that we have not previously seen, and because of which you subsequently decide not to participate in the activity, we will refund you the cost of the activity.

 

 

CLIENT BEHAVIOUR

 

We reserve the right to decline to accept any client unable or unwilling to behave in a manner that is conducive to the satisfactory operation of the tour and the enjoyment of the other members of the group, or whose conduct may affect the reputation of Hens on Tour with our service suppliers.  We shall be under no liability for any costs incurred by such a client as a result of any action we deem necessary to curtail their behaviour.  It is the responsibility of all clients to abide by the safety instructions given during activities and to behave in an appropriate manner.  We shall not be liable to any costs or the resulting circumstance of any client who contravenes the national laws of Turkey.

The collecting of plants and animals in Turkey is illegal and potentially involves the whole group with any resulting legal action by whatever government and we reserve the right to take appropriate action in any such instance.

 

 

CANCELLATION

 

We reserve the right to cancel any activity or booking because of insufficient numbers, problems with supplier(s) or unavoidable and extraordinary circumstances (which include but are not limited to; safety risks, bad weather, civil unrest, terrorism, airline problems, pandemics, natural disasters, fire, flood, drought or any other event beyond our control).  In this unfortunate instance you will be offered an alternative activity and if this alternative costs less then we will also refund you the difference.  Or if you prefer we will refund you in full.  In the event of cancellation through force majeure* we will also issue a full refund. 

 

 

COMPLAINTS

 

It is important to inform us of any aspect of the holiday you are unhappy with immediately, most situations can be easily remedied. If you do not tell us at the time then not only have we missed the chance to investigate and put things right for you there and then and this may also affect your rights under this contract. If you are still unhappy then please write to us within 14 days of the end of the tour. Please notify us immediately of incidences where suppliers have not followed adequate safety protocols and/or not given adequate safety instructions.

 

PASSPORTS

 

It is essential you travel with a full passport, which has at least six months validity from date of entry.
